Slovenia to sue Croatia at top EU court over border arbitration

Belgrade (dpa) - Slovenia will move to sue fellow EU member state Croatia at the European Court of Justice (ECJ) over its refusal to implement an international border arbitration, Foreign Minister Karel Erjavec said Friday.

Ljubljana will send a draft of the lawsuit to the European Commission at the end of February and later to the ECJ, the STA news agency quoted Erjavec as saying.

The lawsuit will be filed under Article 259 of the Treaty of the Functioning of the European Union, which allows an EU members to sue another over violations of the basic EU treaty.

According to Erjavec, EU officials will have three months to decide whether to take over the case or let Slovenia proceed with the lawsuit.

On Monday in Brussels, Slovenian President Borut Pahor urged the European Commission, EU‘s executive arm, "to take a more active position" in the dispute.

The neighbours have feuded over several border areas - most notably over the line in the Bay of Piran in the Adriatic - after they split from the former Yugoslavia in 1991.

They agreed to settle the Bay of Piran dispute through international arbitration in 2013, but Croatia pulled out following reports that Slovenia had made illegal contact with the arbitration panel.

Arbitration resumed, but Zagreb dismissed the verdict when it was reached in late June and refused to implement it when the deadline for that expired on December 29.

The ruling granted Slovenia unhindered access to high seas, contradicting Croatia‘s claim of sovereignty over the contested waters.
