Coca-Cola wins EU trademark battle against Syrian 'Master' brand

Luxembourg (dpa) - Coca-Cola has won the latest round of a trademark battle against Syrian drinks manufacturer Mitico, with an EU court declaring that its "Master" trademark is too similar to the logos used by the US soft drink giant.

Thursday‘s verdict by the European Union‘s General Court is the latest in an ongoing legal dispute since Mitico (Modern Industrial & Trading Investment) applied in Europe to register the logo it uses to brand its products in Syria and the Middle East.

The Master logo uses the same font as Coca-Cola - Spenserian script - which includes a tail swirling from the first letter to underline the name.

Coca-Cola won an initial complaint in 2014, but the EU‘s Intellectual Property Office (EUIPO) subsequently issued a new approval for the Master logo, arguing that the US drinks manufacturer had not provided enough evidence that its brand risked being exploited.

Coca-Cola challenged the decision.

The EU judges again upheld the complaint and annulled the trademark decision, arguing that there was a "future risk of unfair advantage" if Mitico begins marketing its drinks in the EU, according to a court statement.

The fact that the Syrian company had registered its trademark in the bloc suggests that it intended to sell its goods there, the court said.

EUIPO has two months to challenge the decision before the European Court of Justice, the bloc‘s top arbiter.
